These terms and conditions (“Terms”) govern your use of weddingperfumefavors.com (the “Site”) and any orders placed with Wedding Perfume Favors. By using our Site or placing an order, you accept these Terms.

1. Who We Are

Wedding Perfume Favors is a French private-label perfume manufacturer (“we”, “our”, “us”). Our registered office is located in France.

2. Use of Our Website

You may use the Site for personal or business inquiries related to our products and services. You agree NOT to:

  • Copy, reproduce, or distribute our content without permission
  • Use the Site for unlawful purposes
  • Attempt to gain unauthorized access to our systems
  • Send automated requests, spam, or malicious content
  • Misrepresent your identity or affiliations

We reserve the right to terminate access for users violating these rules.

3. Products & Services

3.1 Custom Wedding Favors

All our products are made-to-order and personalized. This means:

  • Production starts only after label proof approval
  • Each order is unique to the couple’s specifications
  • Products cannot be returned or refunded once production begins (see Section 7)

3.2 Product Descriptions

We make every effort to display fragrances, bottles, labels, and packaging accurately. However:

  • Photos on the Site may be illustrative
  • Fragrances may smell slightly different on each person due to skin chemistry
  • Label colors may vary slightly from screen rendering

We provide physical sample kits before any order to help you evaluate the actual product.

4. Orders & Pricing

4.1 How to Order

We do not have a self-service checkout. Every order goes through a personal consultation with our team.

4.2 Pricing

Prices are quoted in USD or EUR depending on your location and are valid for 14 days from the quote issue date.

  • All prices are DDP (Delivered Duty Paid) unless otherwise specified
  • VAT and customs duties are pre-paid by us as part of DDP shipping
  • Prices may vary based on currency exchange rates, raw material costs, and customization complexity

4.3 Minimum Order Quantity (MOQ)

  • 30 units for selected packaging combinations
  • 100 units for full personalization range
  • 200+ units for bespoke fragrance development (exclusive formula)

4.4 Order Confirmation

An order is considered confirmed when:

  • You accept our written quote
  • You pay the 50% deposit
  • We send you a written order confirmation

Until all three conditions are met, no contract exists between us.

5. Payment Terms

5.1 Payment Schedule

  • 50% deposit at order confirmation
  • 50% balance before shipment

5.2 Payment Methods

  • Bank wire transfer (SEPA, SWIFT)
  • Credit card via secure payment processor
  • PayPal
  • For trade accounts with Net 30 status: invoiced payment within 30 days

5.3 Currency

We invoice in EUR or USD depending on your account preference. Currency is locked at quote acceptance.

5.4 Late Payment

For trade accounts on Net 30 terms, late payment may result in:

  • Suspension of new orders
  • Late fee of 1.5% per month on outstanding balance
  • Tier downgrade (e.g., Preferred → Qualifying)

6. Production & Delivery

6.1 Production Timeline

Standard production runs 14 days from approved label proof. The full process from first contact to delivered order takes approximately 8 weeks.

6.2 Delivery

We ship worldwide DDP. Delivery times after production:

  • USA / Canada: 4-7 business days
  • Europe: 2-3 business days
  • UAE / Asia / Australia: 5-9 business days

6.3 Title and Risk

  • Title transfers to you upon full payment
  • Risk transfers to you when the carrier delivers the package to your address (DDP terms)

6.4 Delays

We are not responsible for delays caused by:

  • Carrier issues (lost packages, customs holds)
  • Force majeure (natural disasters, strikes, pandemics, war, government action)
  • Late approval of label proofs by the customer
  • Last-minute order changes

In case of delay, we communicate proactively and work to minimize impact.

7. Cancellations & Returns

7.1 Personalized Orders

Personalized wedding favors cannot be returned or refunded after label proof approval and production start.

7.3 Damage in Transit

Report damage within 48 hours of delivery (with photos). We arrange free replacements within 7 business days.

7.4 Our Errors

If we ship the wrong fragrance, label, or quantity, we replace at our expense with priority production.

8. Warranty & Liability

8.1 Warranty

We warrant that our products:

  • Are made in France using IFRA Amendment 51-compliant ingredients
  • Comply with ISO 22716 (cosmetic GMP) standards
  • Match the agreed specifications (fragrance, label, packaging)

8.2 Limitation of Liability

To the maximum extent permitted by law:

  • Our total liability for any order is limited to the value of that order
  • We are not liable for indirect, consequential, or special damages (e.g., loss of business, emotional distress)
  • We are not liable for fragrance preferences (subjective taste matters)
  • We are not liable for events beyond our reasonable control (force majeure)

8.3 Consumer Rights

These limitations do not affect your statutory consumer rights under applicable law (EU Consumer Rights Directive, US state consumer protection laws, etc.).

9. Intellectual Property

9.1 Our IP

All content on this Site (text, images, logos, fragrance compositions, label designs created by us) is the property of Wedding Perfume Favors and protected by copyright and trademark law. You may not copy, reproduce, or use our content without written permission.

9.2 Your IP

Custom labels you submit to us (your names, photos, monograms, logos) remain your property. By submitting them, you grant us a limited license to:

  • Reproduce them on your wedding favors
  • Use anonymized images of finished favors for our marketing (only with your consent)

9.3 Trademarks

If your design includes third-party trademarks (e.g., venue logos, brand names), you confirm you have the right to use them. We are not responsible for trademark infringement caused by your design submissions.

10. Confidentiality

We treat all wedding details (names, dates, venue, photos) as confidential. We do not share information about your order with third parties except as needed for fulfillment (carriers, payment processors).

11. Compliance & Regulatory

Our products comply with:

  • IFRA Amendment 51 (International Fragrance Association)
  • ISO 22716 (Cosmetic Good Manufacturing Practice)
  • EU Regulation 1223/2009 (Cosmetic Products Regulation)
  • MoCRA Act (USA Modernization of Cosmetics Regulation Act, where applicable)
  • Halal certification (where requested)

Compliance documentation is available upon request, particularly for trade buyers.

12. Changes to These Terms

We may update these Terms from time to time. Significant changes will be communicated via our Site or email. The “Last updated” date at the top reflects the most recent version. Continued use of our Site or placing new orders after changes implies acceptance.

13. Governing Law & Disputes

13.1 Governing Law

These Terms are governed by French law.

13.2 Disputes

In case of dispute:

  • Step 1: Try to resolve amicably by contacting contact@weddingperfumefavors.com
  • Step 2: If unresolved, EU consumers may use the European Online Dispute Resolution platform
  • Step 3: Last resort, disputes go before the courts of Paris, France

13.3 USA Customers

For US customers, certain consumer protection laws may apply (e.g., state-specific warranty laws). Nothing in these Terms limits your rights under such laws.
